If a worker will be treated as an employee rather than an independent contractor, the worker can be enrolled in Upwork Payroll and become an employee of Upwork’s third-party staffing agency.

The staffing agency will handle administrative and legal details that include payroll taxes, employment paperwork, wage payment, workers’ compensation insurance, unemployment insurance, as well as Affordable Care Act (ACA) and other HR/benefit-related issues. On average, it takes 5-7 business days to complete the entire Upwork Payroll onboarding process.

Important: You must not start work until the worker completes onboarding with their employer (the Upwork Payroll third-party staffing agency). Once complete, you can seamlessly communicate and pay through Upwork regardless of worker classification status.

Upwork Payroll is generally available only for desk jobs in office environments and is not available for work involving manual labor, heavy equipment, or driving. Please contact your account rep or Compliance Specialist to discuss pricing.
